Continue Reading »Last night the House voted to pass the bi-patisan HB358, the Protect Life Act, by a vote of 251-172 with 10 Reps not voting. Among the Ayes were 236 Republicans and 15 Democrats. Among the Noes were 170 Democrats and 2 Republicans. See how your Rep voted here.
I sat in the gallery and prayed yesterday during much of the debate. Back and forth and back and forth Rep after Rep repeated the same statements again and again. One side adamantly claiming that the Patient Protection and Affordable Care Act of 2010 allows through creative bookkeeping a path for tax dollars to fund abortions regardless of a taxpayer's personal convictions. This morning the National Federation of Independent Business (NFIB) filed a petition with the U.S. Supreme Court to appeal the 11th Circuit’s decision on Obamacare. This marks an important step following the administration's decision to not ask the 11th Circuit Court of Appeals to review en banc (all 11 judges vs a panel of judges) the August 12 decision of a three-judge panel that found the individual mandate unconstitutional. The NFIB is not appealing the 11th Circuit Court's ruling that the individual mandate is inconstitutional, but instead their opinion that the individual mandate could be severed from the rest of the legislation. The NFIB is asking that the Supreme Court strike down the entire law as unconstitutional. -
Appeals court voices concerns over health care mandate
Continue Reading »U.S. Court of Appeals for the District of Columbia Circuit heard arguments today concerning the constitutionality of the federally-mandated health care takeover passed into law last year. This marked the fourth court to hear challenges to the law. A three-judge panel considered the matter during two hours of oral arguments. The plantiffs include a man who believes in faith healing and does not have medical insurance. While the panel gave no immediate signals as to how it would rule, some concerns over the health care mandate were voiced.
Judge Brett Kavanaugh said, "In 220 years… Congress has never once mandated a purchase." Kavanaugh speculated that if the Justice Department’s position is upheld, there could be a precedent for another governmental mandate not too far in the future. "I can see it coming," Kavanaugh said.
