U.S. Court of Appeals for the District of Columbia Circuit heard arguments today concerning the constitutionality of the federally-mandated health care takeover passed into law last year. This marked the fourth court to hear challenges to the law. A three-judge panel considered the matter during two hours of oral arguments. The plantiffs include a man who believes in faith healing and does not have medical insurance. While the panel gave no immediate signals as to how it would rule, some concerns over the health care mandate were voiced.
Judge Brett Kavanaugh said, "In 220 years… Congress has never once mandated a purchase." Kavanaugh speculated that if the Justice Department’s position is upheld, there could be a precedent for another governmental mandate not too far in the future. "I can see it coming," Kavanaugh said.
